Our Services
At The Flowerday Firm, we focus on providing expert guidance in the following areas of practice:
Probate
Probate is the legal process of settling the estate of a person who has passed away. While probate can be a complex and daunting process, we understand that it's essential to ensure that the deceased person's wishes are carried out. Our team can help you navigate the probate process, whether it involves the appointment of an executor or administrator, or exploring alternative options to minimize court involvement.
Probate options may include Independent Administration, Dependent Administration, Muniment of Title, Determination of Heirship, Affidavit of Heirship, Small Estate Affidavit, Agreements to Not Probate a Will, and Family Settlement Agreements.
Guardianship and Alternatives to Guardianship
Guardianship is a legal process where the court appoints a responsible person to make decisions for an incapacitated person. This can be a critical but sometimes unnecessary process. With careful planning and the execution of legal documents, you can ensure that a trusted relative or friend has the necessary authority to provide for your care if you become incapacitated.
Alternatives to guardianship include powers of attorney, authorization to consent to medical treatment, and trusts. Our team can help you determine the best option for your situation and provide guidance on the responsibilities of a court-appointed guardian and the ongoing requirements for reporting to the court.
Mediation
Mediation is a process that enables parties to a dispute to resolve their differences without the time and expense of a court proceeding. Through mediation, people can craft creative solutions to their differences in ways that may not be available through litigation. We offer mediation services for a range of disputes, including family law matters such as divorce and child custody.
At The Flowerday Firm, we believe in finding the "win-win" for our clients and will advocate for creative solutions to difficult problems. Our attorney, Paula Flowerday, is a trained mediator and certified for appointment as an attorney ad litem and guardian ad litem. We understand the importance of effective communication and will work closely with you to address your legal needs.
